1. AGREEMENT TO TERMS
By making a booking, registering for, or participating in any activities at Frankenstein Adventure Camp ("the Camp," "we," "us," or "our"), you ("Participant," "you," or "your") agree to be legally bound by these Terms and Conditions. These Terms constitute the entire agreement between you and Frankenstein Adventure Camp.
If you do not agree to these terms, you must not participate in any Camp activities.
For participants under 18 years of age, a parent or legal guardian must read, understand, and agree to these Terms on their behalf and will be legally responsible for the minor's compliance.
2. DEFINITIONS
- "Activities" include but are not limited to: camping, cliff jumping, kayaking, snorkeling, boating, and any other recreational activities offered by the Camp
- "Participant" refers to any individual engaging in Camp activities
- "Booking Confirmation" means the invoice or confirmation document issued upon acceptance of your booking
- "Force Majeure Event" means any event beyond our reasonable control including but not limited to: acts of God, severe weather conditions, natural disasters, war, terrorism, civil unrest, epidemic, pandemic, government restrictions, or any other unavoidable and extraordinary circumstances
3. BOOKING AND REGISTRATION
3.1 Age Requirements
- Participants under 18 years of age must be accompanied by a parent or legal guardian during all activities unless otherwise specified
- Parent or legal guardian must complete all registration forms and sign all required waivers for participants under 18
- Minimum age requirements may vary by activity - please refer to specific activity information
3.2 Booking Process
- All bookings will receive an automated email confirmation with booking details and payment instructions.
- Bookings are subject to availability
- We reserve the right to refuse service to any person at our sole discretion
- The person making the booking accepts responsibility for all persons included in that booking
3.3 Payment Terms
- A non-refundable deposit of 30% is required at the time of booking
- Full payment must be made on site
- Accepted payment methods: UPI, Bank transfer & Cash
- If full payment is not made on site, we reserve the right to cancel your booking.
- All prices are in INR and are subject to change without notice until booking is confirmed
3.4 Price Variations
- Trip prices are subject to variable and seasonal pricing based on demand, market conditions, and availability
- Different participants on the same activities may have paid different prices
- Once you have paid your deposit, your price is locked in
4. CANCELLATION AND REFUND POLICY
4.1 Cancellations by Participants
Cancellation requests must be made in writing and will be effective only upon our written acknowledgment. The following cancellation fees apply:
- 30 days or more before arrival: 75% refund (25% cancellation fee)
- 15-29 days before arrival: 50% refund
- Less than 14 days before arrival: No refund
- No-shows or failure to commence activities: No refund
Please note:
- If you leave an activity for any reason after it has commenced, no refund will be made for unused services
- Cancellation fees are in addition to any non-refundable costs incurred from third-party suppliers
4.2 Cancellations by the Camp
- We reserve the right to cancel activities due to weather or safety concerns
- If we cancel your booking, you will receive either:
- A full refund of all money paid, or
- Transfer to an alternative date of your choice
- We will not be responsible for any incidental expenses you may have incurred including but not limited to transportation, accommodation booked separately, or other arrangements made in connection with your booking
4.3 Force Majeure Cancellations
In the event of a Force Majeure Event that significantly affects the performance of activities or makes it dangerous or impractical to proceed:
- All Force Majeure cancellation requests—whether initiated by us or by you—will be reviewed on a case-by-case basis
- We will make every reasonable effort to accommodate affected guests, but we cannot guarantee refunds, credits, or rescheduling in all circumstances
- Any refund or credit offered will be at our sole discretion and may be subject to deductions for costs already incurred
Please note:
- Neither party will be liable for consequential damages or incidental expenses (e.g., airfare, hotel bookings) incurred due to Force Majeure Events
- Personal inconvenience, change of plans, or general concerns do not qualify as Force Majeure Events
5. MODIFICATIONS TO BOOKINGS
- Transfers to another person or alternative activity dates are permitted only when operationally possible and subject to approval
- Transfer requests must be made in writing at least 14 days before the activity date
- A transfer administration fee may apply
- No amendments are permitted within 14 days of your activity date
- The transferee must meet all requirements and conditions for participation
6. HEALTH, FITNESS, AND MEDICAL REQUIREMENTS
6.1 Health Declaration
You must disclose all relevant information about your physical and mental health, including:
- Pre-existing medical conditions
- Recent surgeries or injuries
- Current medications
- Allergies
- Disabilities that may affect participation
Failure to disclose relevant medical information may result in immediate dismissal from activities without refund and may void any insurance coverage.
6.2 Physical Fitness Requirements
- You must be in adequate physical condition to safely participate in activities
- Activities involve strenuous physical exertion and may not be suitable for persons with certain medical conditions
- We reserve the right to exclude any participant we deem unfit for specific activities for safety reasons
- It is your responsibility to assess your own fitness level and consult a physician if uncertain
6.3 Specific Health Restrictions
Activities may not be suitable for individuals who:
- Are pregnant
- Have heart conditions or abnormal blood pressure
- Have back, neck, or joint injuries
- Experience motion sickness or dizziness
- Have recently undergone surgery
- Have respiratory conditions
- Are under the influence of alcohol or drugs
6.4 Medical Treatment Authorization
By participating, you authorize Camp staff to:
- Obtain emergency medical treatment if necessary
- Make decisions regarding your medical care if you are unable to provide consent
- Share relevant medical information with emergency services and medical providers
You are responsible for all costs associated with medical treatment, emergency evacuation, hospital care, and related expenses.
7. ASSUMPTION OF RISK AND ACKNOWLEDGMENT OF DANGER
7.1 Inherent Risks
YOU ACKNOWLEDGE AND AGREE that participation in camping, cliff jumping, kayaking, snorkeling, boating, and related activities involves inherent and significant risks including but not limited to:
- Death or serious personal injury
- Drowning and near-drowning incidents
- Impact injuries from falls, collisions, or cliff jumping
- Hypothermia and cold water immersion
- Heat exhaustion and dehydration
- Head, neck, and spinal injuries
- Broken bones and lacerations
- Equipment failure or malfunction
- Unpredictable water conditions, currents, and undertows
- Hidden underwater obstacles and hazards
- Adverse and changing weather conditions
- Capsizing of boats or kayaks
- Wildlife encounters
- Slippery and uneven terrain
- Actions or errors by staff, guides, or other participants
- Remote locations with limited access to medical facilities
7.2 Voluntary Assumption of Risk
You acknowledge that:
- Participation is entirely voluntary
- You have been informed of the risks involved
- You voluntarily assume all risks of injury, death, property damage, or loss
- You accept responsibility for your own safety and well-being
- You are not relying on any oral or written representations about safety other than what is stated in these Terms
8. RELEASE OF LIABILITY AND INDEMNIFICATION
8.1 Release and Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, you hereby release, waive, discharge, and covenant not to sue Frankenstein Adventure Camp, its owners, officers, directors, employees, agents, contractors, affiliates, insurers, and successors (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to:
- Any loss, damage, injury, or death to you or your property
- Your participation in any Camp activities
- The negligence of the Released Parties (except for gross negligence or willful misconduct)
- Any act or omission by the Released Parties in connection with the activities
This release applies to claims based on negligence, breach of contract, breach of warranty, or any other legal theory.
8.2 Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all:
- Claims, liabilities, damages, losses, costs, and expenses (including legal fees)
- Arising from or related to your participation in activities
- Resulting from your violation of these Terms
- Caused by your negligence or intentional misconduct
- Including claims by third parties for damage or injury you cause
This indemnification obligation survives the termination of your participation in activities.
8.3 Limitation of Liability
To the maximum extent permitted by law:
- We exclude all liability for any indirect, consequential, or incidental damages
- Our total liability to you shall not exceed the amount you paid for the activities
- We are not liable for loss or damage to personal property
- We are not liable for the acts or omissions of third-party suppliers or other participants
This clause does not exclude liability that cannot be excluded by law, including liability for:
- Death or personal injury caused by our gross negligence or willful misconduct
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded or limited under applicable law
9. SAFETY RULES AND PARTICIPANT CONDUCT
9.1 Mandatory Safety Compliance
All participants must:
- Attend and complete all mandatory safety briefings
- Follow all instructions from Camp staff and activity leaders immediately and without question
- Use all provided safety equipment correctly (including personal flotation devices, helmets, etc.)
- Never remove or modify safety equipment without staff authorization
- Report any safety concerns or hazards to staff immediately
- Stay within designated activity areas
- Refrain from taking unnecessary risks
9.2 Authority of Staff
- The decisions of Camp staff and activity leaders regarding safety are final and binding
- Staff have absolute authority to modify, suspend, or terminate activities based on safety concerns
- Staff may require any participant to stop participating if they pose a risk to themselves or others
9.3 Prohibited Conduct
The following behaviors will result in immediate dismissal without refund:
- Failure to follow safety instructions
- Reckless, dangerous, or disruptive behavior
- Intoxication or being under the influence of alcohol or drugs
- Harassment, bullying, discrimination, or abusive behavior toward staff or other participants
- Intentional damage to property or equipment
- Engaging in activities while impaired or in an unsafe condition
- Violation of local laws or regulations
9.4 Alcohol and Substance Use
- Participants under the influence of alcohol or drugs will not be permitted to participate
- Consumption of alcohol or drugs before or during activities is strictly prohibited
- If you consume alcohol or drugs before or during activities, you assume all responsibility for any resulting injury, loss, or damage to yourself or others
9.5 Equipment Use and Responsibility
- All equipment must be used only as instructed
- You are responsible for inspecting equipment before use and reporting any defects
- You will be held financially responsible for loss or damage to equipment caused by your negligence or misuse
- Return all equipment in the condition provided (normal wear and tear excepted)
10. INSURANCE REQUIREMENTS
10.1 Mandatory Insurance
Travel and activity insurance is strongly recommended for all participants. Your insurance should cover:
- Personal accident and death
- Medical expenses and emergency medical evacuation
- Trip cancellation and curtailment
- Personal liability
- Loss of personal belongings
10.2 Insurance Verification
- You may be required to provide proof of insurance coverage before participating
- You acknowledge that Frankenstein Adventure Camp does not provide insurance coverage for participants
11. EMERGENCY PROCEDURES
11.1 Emergency Response
- Staff will provide reasonable first aid within their training
- Emergency medical services will be contacted as necessary
- You authorize staff to take necessary action to ensure your safety and well-being
11.2 Medical Costs
You are solely responsible for all costs associated with:
- Medical treatment and hospitalization
- Emergency evacuation or transport
- Ambulance services
- Follow-up medical care
- Any other medical-related expenses
11.3 Emergency Contact Information
You must provide accurate emergency contact information and ensure this information is up to date.
12. PERSONAL PROPERTY
- The Camp is not responsible for loss, theft, damage, or destruction of personal property
- Do not bring valuable items; secure all belongings
- Use designated storage areas at your own risk
- The Camp may provide lockers or storage but assumes no liability for items stored
13. PHOTOGRAPHY AND MEDIA USAGE
- We may photograph or video record activities for promotional, marketing, and training purposes
- By participating, you grant us a perpetual, royalty-free, worldwide license to use your image and likeness
- If you object to being photographed or filmed, you must notify us in writing before activities commence
- You may not use Camp branding, logos, or trademarks without written permission
14. WEATHER AND ENVIRONMENTAL CONDITIONS
14.1 Weather-Dependent Activities
- All outdoor activities are subject to weather conditions
- Activities may be modified, postponed, or cancelled due to adverse weather
- Staff decisions regarding weather-related changes are final and made in the interest of safety
14.2 No Guarantees
- We do not guarantee specific weather conditions or environmental experiences
- No refunds will be given for weather-related modifications made for safety reasons while activities are in progress
15. ITINERARY AND ACTIVITY CHANGES
- Activity schedules and itineraries are subject to change at our discretion
- We reserve the right to substitute activities of equal or similar value
- Changes may occur due to weather, safety concerns, equipment issues, or operational needs
- We will inform you of significant changes when reasonably possible
- No compensation will be provided for minor changes or reasonable modifications
16. THIRD-PARTY SERVICES
- We may contract with third-party suppliers for certain services (e.g., equipment, transport, accommodation)
- We take reasonable care in selecting reputable suppliers
- Third-party services are subject to the supplier's own terms and conditions
- We are not responsible for the acts, omissions, or negligence of third-party suppliers
- Claims against third parties must be resolved directly with those parties
17. PRIVACY AND DATA PROTECTION
17.1 Information Collection
Personal information collected includes but is not limited to:
- Contact details
- Medical information
- Emergency contact information
- Payment information
17.2 Use of Information
We use your information to:
- Process bookings and provide services
- Ensure safety and emergency preparedness
- Communicate important information
- Comply with legal obligations
- Improve our services
17.3 Data Protection
- We will handle your personal information in accordance with applicable privacy laws
- We will not sell or share your information with third parties for marketing purposes without consent

18. COMPLAINTS AND DISPUTES
18.1 Complaints
- If you have a complaint during an activity, inform staff or the activity leader immediately so we can attempt to resolve the issue
- Written complaints must be submitted within 30 days of the activity date

18.2 Dispute Resolution
- We will make reasonable efforts to resolve disputes amicably
- If informal resolution fails, disputes shall be resolved in accordance with the laws specified in Section 19
19. GOVERNING LAW AND JURISDICTION
- These Terms and Conditions are governed by the laws of Meghalaya, India
- Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Meghalaya
- To the extent permitted by law, you waive any right to trial by jury
20. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable:
- That provision shall be severed
- The remaining provisions shall remain in full force and effect
- The invalid provision shall be replaced with a valid provision that most closely reflects the original intent
21. ENTIRE AGREEMENT
These Terms and Conditions, together with:
- Your Booking Confirmation
- Any activity-specific waivers
- Our Privacy Policy
constitute the entire agreement between you and Frankenstein Adventure Camp and supersede all prior agreements, understandings, and representations.
22. AMENDMENTS
- We reserve the right to modify these Terms at any time
- Changes become effective immediately upon posting
- Continued participation after changes constitutes acceptance of modified terms
- Material changes will be communicated to participants with existing bookings
23. NO WAIVER
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.
24. LANGUAGE
These Terms are written in English. If translated into other languages, the English version shall prevail in case of any discrepancy.
25. PARENTAL/GUARDIAN RESPONSIBILITIES
For participants under 18 years of age:
- The parent or legal guardian agrees to these Terms on behalf of the minor
- The parent/guardian is responsible for ensuring the minor's compliance
- The parent/guardian agrees to indemnify the Camp for any claims arising from the minor's participation
- The release and waiver apply with the same force as if the minor were of legal age
